Be-Drive.com ("Be-Drive," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This policy describes our procedures for handling copyright infringement claims in accordance with the Digital Millennium Copyright Act (DMCA).

 

1. Reporting Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any content hosted on Be-Drive infringes upon your copyrights, you may submit a DMCA Takedown Notice to our designated Copyright Agent.

Your notice must include the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.

  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., specific URLs of the file(s)).

  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and an email address.

  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

 

2. Designated Copyright Agent

All DMCA notices should be sent to our Designated Copyright Agent at the following address:

Please note that only DMCA notices should be sent to this address. All other inquiries will not be addressed.

 

3. Be-Drive's Response

Upon receipt of a valid and complete DMCA Takedown Notice, we will:

  • Remove or disable access to the infringing material.

  • Notify the user who uploaded the material that it has been removed or disabled.

  • Take reasonable steps to notify the user of the claim and provide them with the opportunity to submit a counter-notification.

 

4. Counter-Notification

The user who uploaded the material may file a DMCA Counter-Notification if they believe the content was removed by mistake or misidentification.

Your counter-notification must include the following information:

  • Your physical or electronic signature.

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.1

     

  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disa2bled as a result of mistake or misidentification of the material to be removed or disabled.

     

  • Your name, address, and telephone number.

  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Be-Drive may be found, and that you will accept service of process from the person who provided the original DMCA Takedown Notice.

 

5. Repeat Infringers

Be-Drive has a strict policy of terminating the accounts of users who are determined to be repeat infringers. We reserve the right to terminate an account at any time for any reason, particularly if a user is found to have repeatedly uploaded infringing content.
